Private Jet Services Group (PJS), based in Miami Beach, has recently filed a federal lawsuit against Westchester County Airport (KHPN) in New York. The suit, which was filed in the Southern District of New York, accuses the county and airport executive director April Gasparri of discriminatory denial of access to the airport for Boeing 757-200 charter flights operated by PJS.
PJS alleges that the county and airport officials implemented restrictions without any public notice or justification, which included an unofficial policy limiting the number of Boeing 757-200 aircrafts allowed to land and take off from the airport per day. This policy was not documented and was selectively enforced, resulting in PJS being denied access to the airport.
PJS also noted that Delta Air Lines, a major airline, uses HPN for charter flights using almost identical Boeing 757-200 aircrafts for MSG Sports, including teams like the New York Knicks and New York Rangers. These Delta flights occurred during the same time period as PJS’s denied flights.
The lawsuit highlights concerns about transparency, fairness, and equal access at an airport that is publicly funded. PJS is seeking declaratory and injunctive relief in order to prevent any further arbitrary and discriminatory treatment and to restore fair access to the airport.
This legal action by PJS raises questions about the operations and policies of Westchester County Airport and its officials. It also brings attention to the need for equal and fair treatment for all operators at publicly funded airports.
PJS’s lawsuit is a step towards addressing these issues and ensuring that all operators, regardless of their size or status, are granted equal access to the airport. The charter company hopes for a resolution that will promote transparency, fairness, and equitable access for all at Westchester County Airport.
